1. Purpose of the Contract

www.mobicarrier.com is property of Proline S.L. a limited company registered in Spain. These general conditions will regulate the contractual relationship between www.mobicarrier.com, (or “Mobicarrier”) and the client (you), by virtue of which Mobicarrier acts as the disclosed agent of the supplier.

For the provision of our services we work with private transport operators (or “Suppliers”) who provide professional transport services for the transfer of passengers, or who act as an agency with legal capacity to offer transport services and who are in possession of all the necessary licenses and permits according to the legislation applicable to each one of them for the realization of this activity in any country we provide our transfer booking services.

The terms and conditions applicable to the contract between you and the supplier are available by request and are set out in the booking conditions of the relevant supplier. Mobicarrier acts as the disclosed agent for its suppliers thus it cannot accept any liability arising from the provision of the services.

By booking on our website, you agree that the contract for the use and provision of the service is between you and our provider (the provider of the service). If the reservation is made by an agency, or any other person acting on your behalf, it is considered to be acting as an agent of all passengers who use the service as well as yourself. You agree to be bound by these terms and conditions as well as other information contained on the website.

By making a reservation you confirm that you have read these Terms and Conditions and that you have the legal capacity to accept them on your own behalf and on behalf of all passengers using the services.

These general conditions may change without prior notice and any change will be communicated by email, our app, our website or any other means that you have provided us with this purpose.

2. The Booking Process: Payment and Contract

Bookings can be made online on our website, our mobile app or by phone. If the booking is made for two or more people, the person making the booking (“the Lead Party”) is considered to have done so on behalf of all the passengers and he or she accepts these terms and conditions on behalf of any passenger of the party. The Lead Party must be at least 18 years of age.

Full payment is required at the time of booking. On receipt of full payment, Mobicarrier will process the booking and after confirmation will send to the Lead Party the transfer services details which you have booked and the booking voucher. The voucher acts as ‘ticket’ and must be presented to the supplier representative or driver.

At our discretion and on selected routes you will be able to book the services by making a low initial deposit, this initial low deposit bookings will only be available if you book 20 days minimum in advance of the date of use of the service. All deposit payments made are non-refundable once the booking has been confirmed. The outstanding balance will be automatically deducted 7 days before the service use date from the same credit/debit card you have used to pay the initial deposit, if the outstanding balance is deducted you will be liable for the full value of the booking and no refunds will be made in case of cancellation.

When booking is confirmed a legally binding contract will be created between the Lead Party (and all of the passengers listed on the booking) and the supplier. No binding contract is created until full payment has been received. If you are booking via a Travel Agent no contract will be created between you and a supplier until full payment has been received from your travel agent.

Mobicarrier or its suppliers cannot be held responsible or liable for timeliness, accuracy or quality of the services due to incorrect information provided at the time you book the service. It is the Lead Party’s responsibility to check that all the details of the booking are correct prior to travel and inform Mobicarrier if there are any errors in advance.

3. Child Seats

Please ensure that you are aware of the local legislation when travelling with children. In some destinations children must use appropriate child seats. You are responsible for correctly providing all the information of the passengers at the time of booking and in case of traveling with children choose the necessary extras to adapt to the legislation of the country where you have booked the service. In some cases, child seats extras are not free and must be paid by you at the time of booking.

Own child seats or lifts can be used in some cases, you must inform us of this at the time the booking is made. We have to ensure that the vehicle used by the supplier is compatible with the retention system. Minibuses or coaches are used in some cases when travelling with big groups and in these vehicles, it is not possible to use child seats.

4. Child Pricing

All children and babies, regardless of their age, will be taken into account to determine the capacity of the vehicle to use, and therefore must be entered in the total number of passengers at the time of booking.

5. Disabled Passengers

In some destinations, Mobicarrier, through its suppliers, offers transportation services for people with disabilities or reduced mobility. In case of booking a vehicle of these characteristics you are responsible that the reserved vehicle perfectly adapts to the needs of the people traveling in it. We recommend contacting our customer service department before booking a vehicle of this kind, so they can help you choose the vehicle that best suits the needs of all passengers.

6. Amendments

Booking amendments can be made free of charge up to 24 hours before the use of the first service contained in any booking confirmed by us. Changes made less than 24 hours prior to the use by you of the first service must be made directly by sending an email from the email address which you provided at the time of booking to [email protected], quoting your booking reference number, lead passenger name and the changes you require. Amendments may result in extra charges and you must pay these charges prior to any changes being made.

Amendments cannot be made changing to a different destination than that specified in your booking. Only extras, pick-up and drop-off hours can be amended. We generally do not charge for amendments or changes to your booking, although we reserve the right to do so in the event the amendment increases the price of your original booking.

7. Cancellations

Cancellations must be made by you using our website, app or by sending an email to [email protected]. If you cancel your booking more than 24 hours prior to the date on which you use the first service confirmed in your booking you will be fully refunded.

If you cancel your booking less than 24 hours prior to the date on which you use the first service confirmed in your booking you will not be entitled to any refund.

If you booked with a deposit and cancel 8 or more days in advance, the remaining balance won’t be charged, but the deposit is still non-refundable. If you don’t use the service and fail to cancel, no refund will be given. All refunds are credited to the original form of payment.

7.1 Cancellations by Us

In extraordinary cases, if our supplier must significantly change or cancel the service, we will try to find viable alternatives. If no solution is found, you will receive a full refund, which covers all our obligations related to the cancellation.

8. Vehicles Booked

We will try to respect your vehicle choice; however, it may be replaced by a vehicle with greater capacity or multiple vehicles depending on availability. If the change results in a downgrade, the price difference will be refunded. All vehicles are insured according to local law.

9. Luggage

Private transfer vehicles can carry one medium suitcase per passenger seat (approx. 70cm x 50cm). You must inform us in advance of any extra luggage. Additional transport costs due to undeclared baggage will be your responsibility.

Do not include illegal or dangerous items, or luggage that is excessively large, heavy, or fragile. Pets are not allowed unless you are traveling with a guide dog (must be informed at booking). Mobicarrier and its suppliers are not responsible for loss or damage to luggage or personal items.

10. Services

We offer private transfer services. Routes shown on our website are indicative and may vary. Pick-up and drop-off times are approximate. If the driver cannot locate you, they will call the mobile number provided. You must have that phone with you and it must be on.

If your flight/train/ship is delayed over 60 minutes, service cannot be guaranteed. If you cannot be found or do not notify the supplier, no refund will be given. If you use alternative transport without authorization, no compensation will be provided. If authorized, retain your receipt for review.

In some cases, due to access restrictions or local conditions, you may be picked up/dropped off at a central point near your destination. If alternate routes are required (e.g. due to weather), you may incur additional costs.

11. Your Responsibility

By formalizing this contract, you declare that:

  • You are over 18 years of age and mentally capable of accepting these conditions.
  • You are the rightful owner of the payment card used and have sufficient funds to complete the transaction.
  • You will notify us of any changes to your personal data as soon as possible.
  • You are responsible for providing correct documentation for border crossing. Our voucher is not valid for obtaining a visa.
  • You are responsible for verifying pick-up times and arriving on time at your departure point.

The services will be delivered according to the information you provided and was confirmed via email. It is your responsibility to check and correct booking details, especially the voucher. If the information is incorrect, you must contact our customer service immediately. We do not refund services that are not carried out due to your own errors or lack of information.

If Mobicarrier or its supplier incurs any fines or deposits due to your failure to comply with applicable laws, you will be liable for all resulting costs. We reserve the right to charge your card for damages, fines, special cleaning, or missing items in supplier vehicles.

We reserve the right to deny service to customers who have caused significant or repeated incidents.

12. Our Responsibility

We are liable only for direct damages caused by our proven negligence, up to the value of the booking. We are not liable for delays, losses, or failures caused by force majeure events such as natural disasters, strikes, road accidents, traffic, or police activity.

We are not responsible for the actual performance of the transfer services unless it is proven we failed in selecting qualified suppliers. Illness, personal injury, or death during service is only our responsibility if proven to be a result of our negligence or that of our employees or suppliers. The burden of proof lies with the customer.

13. Complaints

If the service does not meet your expectations, contact our customer service or the local supplier (contact info on your voucher) immediately. Written complaints must be submitted by email to [email protected] within 28 days of your return date.

14. Passenger Conduct

We and our suppliers reserve the right to refuse service to any passenger who is:

  • Under the influence of drugs or alcohol
  • Behaving dangerously or inappropriately toward the driver or other passengers

Consumption of alcohol or drugs is strictly forbidden in the vehicles. Smoking and eating are not allowed.

15. Travel Insurance

We strongly advise all customers to obtain appropriate travel insurance. It is your responsibility to ensure the policy covers your specific needs.

16. Jurisdiction

These conditions are governed by Spanish law. Any legal disputes will be handled by the Spanish courts. If any condition is deemed unlawful or unenforceable, all other terms remain in full effect.
